Dr Aafia’s Case Exposed the US judicial System

Guest Blog by Talkhaba

“The American court acquits Dr Aafia Siddiqui” The ticker blinks on TV screens is followed by the screen flashes “Breaking News; The US court releases Afia Siddiqui” “The justice has been made by the exemplary American judicial system.”

The News anchors inform us that Pakistani Ambassador to the US Mr. Hussain Haqqani will hold a press conference shortly. At the same time, the tickers read “Quid-e-Tehreek Altaf Hussain has praised Americans for making justice and freeing the daughter of Nation” The news anchors announce that MQM chief has made a phone call to Aafia’s mother which is to telecasted on TV channels live. The audience listens to Altaf Hussain. He is followed by messages from President of Pakistan, Mr. Asif Ali Zardari, Prime Minister, Yousaf Raza Gilani, Interior Minister, Mr Rehman Malik, chief of Pakistan Muslims league (N) Mr. Mian Nawaz Shareef, Secretary General Pakistan Muslim League (Q) Syed Mushahid Hussain. Besides, shorts statements of different national leaders are displayed at TV screens, all congratulating Aafia’s family and praising US judicial system.

After a while TV channels started three to four footage at the same time, the one covering Dr Aafia’s resident in Karachi, the second one showing different leaders praising America. The third footage shows footage of press conferences by Afia Lawyers and Hussain Haqqani live from New York. All member of MQM’s Rabta committee have gathered at Aafia’s residents showing their speaking abilities in front of camera. Besides, dozens of local leaders of all political parties are trying to stand beside Mrs. Asmat Siddiqui, Mother of Afia Sidduiq and her sister Dr Fauzia Siddiqui, who are ready to give their views on Aafia’s Acquittal.

Fortunately or unfortunately we couldn’t see all this, not because our political leadership had gone to bed that late night but the US jury had found Dr Aafia “Guilty”, and no one would opt to speak against the United State which has Washington, the de facto capital of Pakistan. Some two days before I was telling my wife how would the house of Aafia looking. After listening about the verdict she reminded me that I was wrong. “But I didn’t say that the verdict will be against Aafia, now when the verdict has changed, we wouldn’t be able to see the waving colorful flags of different political parties inside Aafia House. But yes Altaf bhai is very much there, although he is Altaf Shakoor, president of Pasban”, I relied.

Not to mention the response of our political leadership was disappointing but the reaction of Aafia Mother and Sister’s was not just encouraging but a milestone for the struggle of those who are working against the terrorist and bastard American nation’s inhuman and terrorist policies. Mrs. Asmat Siddiqui informed us that the “it [the verdict] is the beginning of the end of America”. No doubt its Allah’s willing that HE chose Aafia Siddiqui for exposing the bias judicial system of America. Allah (SWT) does his work if even we do nothing but don’t we have any responsibility?

Our responsibly is to protest peacefully against the cruel and brutal policies of the United State of America which will soon turn into distributed States of America InshaAllah, but this is not our prime responsibility. Our prime duty is to get red of their agents who have held the reign of power in our Muslim countries. Nearly all rulers in the Muslim world, Pakistan being the worst, are more characterless than pimps; the later at least have the courage to declare what they are. But these pimps don’t open their mouth when their “father” do anything negative.

Although, my words may be harsh, but there is nothing final at my end. Instead I want to start a debate which should result in consensus that what practical steps we can take to get our sister Aafia back home and convict the bastards who are in any level responsible for handing over to America. The first thing we can to is to declare their sister A.W.Patterson as persona no grata, who is directly mentoring the crusader armies inside Pakistan under diplomatic cover.

I'd say this post is a highly sentimental one! And thus, contains many contraries to real facts 🙂

However, I believe that Pakistani government displayed extreme docility in pursuing Aafia's case and resultingly, even when we've been told by Afghan witnesses that she didn't take those shots, she's been found guilty and has in act been denied justice. And that, indeed, is shameful.

Mr Talkhaba's post is right on the point and those Muslims who are living in the West particularly USA, Great Britain and in any of those European Countries who are US Allies [or even enjoy diplomatic relations with USA] should purify their Islam and leave those countries and return to their Muslim Countries.

Lo! as for those whom the angels take (in death) while they wrong themselves, (the angels) will ask: In what were ye engaged? They will say: We were oppressed in the land. (The angels) will say: Was not Allah's earth spacious that ye could have migrated therein? As for such, their habitation will be hell, an evil journey's end; [AN-NISA (WOMEN) Chapter 4 Verse 97]

Prophet Mohammad (peace and blessings of Allaah be upon him) said: “I disown every Muslim who settles among the mushrikeen.” [Sunnan Abu Dawood]

It is obligatory to migrate from the kaafir lands to the Muslim lands for those who are able to do that, if they are unable to practise their religion openly.

Ibn al-‘Arabi al-Maaliki said: Hijrah (migration) means leaving dar al-harb [non-Muslim lands] and going to dar al-islam [Muslim lands]. This was obligatory at the time of the Prophet (peace and blessings of Allaah be upon him) and remains so after his time for those who fear for their lives. From Nayl al-Awtaar, 8/33, by al-Shawkaani.

Al-Haafiz Ibn Hajar said concerning the hadeeth, “I disown every Muslim who settles among the mushrikeen”:

This is to be understood as referring to those who are not safe to practise their religion there. Fath al-Baari

What frustrates me is that out "conventional media" is not playing the role it should have. Why don't our so called "leaders" think Dr. Aafia as their own sister/daughter and do anything to get her back? Why don't we as a nation get together on this issue and tell the world that this is wrong. Are we so unconscious that we cannot raise any voice for her? Today its Dr. Aafia, tomorrow it can be your sister or mine. What would we do then? Keep our mouths shut? We need to get together and hit the road (peacefully) like we did for chief justice.

Please guys don't expect any thing from these *leaders*, they are more faithful to their employer than Pakistan and Pakistanis…

Even the biggest champion of democracy, Benazir Bhutto, had to beg to get into Elections… so they all know who runs the affairs….so can they offend and hence loose the opportunties?

Lets not call them leaders, lets call them vice-roys.

I think your post is balanced. The Aafia Siddiqui case is gross inhuman rights violation and a blunder in judicial terms. This is not the first time the American "justice" system has failed and nor will it be the last time.

"he first thing we can to is to declare their sister A.W.Patterson as persona no grata, who is directly mentoring the crusader armies inside Pakistan under diplomatic cover."

This is wishful thinking. Do you really believe that the PPP CORRUPT-TO-THE-CORE-government will do anything like that?

But, no doubt that should have been an option, but we should have combined that option with disruption of supply lines to Afghanistan, and start shooting warning shots on drones, and if it doesn't help then start shooting down any intruding drones. Off course we also need to clean up Blackwater/Xe.

while penning down this post i had in mind the post already published at this and other blogs. My post presents the sentimental dimension. I am human being. Though i don't know whether the animals have sentiments or not but the human beings who can sense and feel should have this.

You are looking very emotional in this matter which is surely out of range of weak and beggar like Pakistan's govt.

I can assure you that Musharraf and his government was in hurry for cashing her head money , otherwise Aafia was also interested in going back to US before her ambushed arrest in Karachi.

If she would have been daughter of any general or top bureaucrats, she should be treated in different manner, no matter how far our army had to go but they would do it to get her back .

So such civilians targets are required to fill the charge sheet of Alqeeda for whom US and NATO forces have spent billion dollars. This way they divert the attention of public towards real culprits .So more the time would be passed, more charges would be put in her accounts.

Americans can get rid of her while she was in Badghram jail but they purposely kept her alive as a piece of lure so that other can be traced while tracking her in US jails. So it should be obvious to all of us that she couldnt liberated until CIA would reach to their real target through her.

Her involvement with suspicious Arab people is clear to all and from her example one should realize that at the time of trap no hidden power would come to help such characters. They must realise their status is just negligible for these hidden forces who first use their passion and energy in wrong direction and then discard them.

great article by Talkhaba!!a true representation of the emotions of the pakistani muslim…

the battle is not over yet.the case can be taken into higher courts.I believe that there is chances of dr.Afia's release from american custody but on the other hand there is literaly no chance of indictment of those who handed over poor and helpless lady to the barbaric americans. for this purpose i believe we need a bloody revolution.

I wonder why our homegrown mems/baboos are not yelling about womens right etc. WHY? Because their masters are behind this cruel act of abduction and unjust treatment of Aafia?

    Where are they?

  14. Adnan Siddiqi Avatar

Observer, the reason is that noone fed hungry and greedy NGO organizers like Samar MinAllah who acts like a front-end prostitute s for US and it's allies. Since Aafia was tortured in US hence it's not "Haraam" for NGO and it's permissible to torture her. HAd it been done by some Mullahs or Muslim then every NGO was going to pop out and started yelling at Islam,Pakistan or what not. I am not surprised at such attitude. Even prostitutes are better than such NGO organizers who depend on money they are given for poorest people of the country. Shame on them
