Kerry-Luger Bill: Signing a Political Death Warrant

kerry-luger-billKashmir policy, acquiring nuclear asset(s) and Army has been sensitive issues for Pakistan since its birth in 1947. Though there can be no disagreements that Army rule could not bring change by ridding corruption and opening flood gates of economic progress by sacking popular leaderships in their four trials in 1958, 1969, 1977, and 1999 respectively. Having said that there has not been a paradigm shift in the love for its main stream Army, lust for independence of Kashmir and acquiring a sustainable mechanism to hold on to nuclear assets for a just deterrent, and maintaining state sovereignty.

Kerry Lugar Bill entails conditions quite to the opposite of Pakistani people’s psyche and character. USA has always been supportive of Pakistan’s military regimes and to some critic it’s a long standing policy of the west to mentor its upcoming generals and through nexus of Judges and Generals bring about a Govt of military Generals after a brief spell of civil rule on the name of ridding corruption, economic progress, stability and accountability. Past state record of Pakistani governments supports itself of that version of theory.

When writer spoke and enquired from one of the judges visiting UK who was sitting in the bench giving judgment of Zafar Ali Shah who challenged General Musharraf’s coup, as to how come Supreme Court gave General Musharraf the powers what even the SC did not have the power to grant meaning ‘to amend constitution’. He bluntly replied that ‘it was superpower who wished for that and our economy was such that we could not say no to it’. Thus thankfully General Musharraf was given carte blanche to do whatever with the constitution and the nation saw his tailor work in the form of LFO, 17th amendment, etc.

Kerry-Lugar Bill is asking the weaker Govt to tame the military making it sub civil rule, aid the Indians by finishing all sorts of safe heavens without resolving Kashmir, give access to Dr Abdul Qadeer and any one who is intending to proliferate, and curb militant tendencies which aid outfits in northern frontier areas causing increase in attacks or strategic losses to NATO and US forces even if it may cost the state an unbearable loss. President Zia’s 100 billion dollar aid package is no where seen to be coming and 1.5 billion annual package is linked to Word Bank monitoring.

This aid package is doable or not but is quite indicative that civil rule is asked to do what it cannot deliver in 100 years, but may lose what it has got ‘the Govt’. In the past, President tried to be friend with India single-handedly but failed. Interior Ministry tried to bring (ISI) Inter Services Intelligence under its control, but in vain. Now committing to curb military and control its promotions is such a thorny issue which may cost the civilians its Govt and leaders their lives. We have seen what happened to Bhutto and Nawaz Sharif when they acted without consensus and consultation amongst political forces. One could not save his life and the other had to remain in exile for years.

Ideally, military must work under civilian rule that in principle is a correct approach, but looking at the ground realities, Pakistan which has seen off four military regimes covering over three decades require the civilian rulers to work jointly towards that cause with joint consultation, and consensus. The way President has humiliated and discarded the ‘charter of democracy’, it seems he is not interested at all in bringing change which was envisaged by Benazir Bhutto and Nawaz Sharif, both former premiers, who claimed to have learnt from their past mistakes. They had a vision, vote bank and responsibility to effect change in the common man’s life without disturbing the stakeholders and bringing in democracy in its true shape and form. Though it was a slow process but had a salvation plan in it, if the system is allowed to shuffle three or four times on the pattern of agreed formula ‘CoD.

The way things are progressing, the Govt’s hand is twisted to bell the cat which is not doable unless PPP in all honesty works with Conservative forces and time to me has already gone for that consultation as the way Govt is treated on its ‘credibility’ its evident that no one is willing to give them ‘hard cash’, and there is a trust deficit looming around them. Times article is haunting them, and day to day mal-governance is chasing them every where.

What new aid package requires them to do is not at all practical. People will revolt, army will check and Parliamentary leaders will protest, and new Ginny of media will expose them to an extent that it will be unthinkable for them to do a single one of it. I think its time for the rulers to rethink, realign their targets and get on with the business of implementing the ‘Charter’ before its too late as by signing these conditions of new aid package they will be agreeing to their political death warrants as who will let them hand over Dr Qadeer Khan to USA, and sack General Kiani.

Finally, unless political forces truly has the confidence of masses like they had after February 18 elections, who will stop Army intervening, these ones, who will run to their place of permanent abode on the first whistle with their foreign passports. Army will only go if the Parliament is strong, if the 1973 constitution is implemented in its entirety and if rule of law, justice and good governance come in action. At this very moment we are far far away from that position. I think either USA is bluffing or our innocent leaders are living in Cukoo’s land if aspiring to implement these conditions.

    it is a danger sign for pakistani nation because many restrication has been imposed on Zardari adminstration but these are not cleraly shown in this bill,be remember when you take any aid from Usa .

    I am thinking on the same lines.

    People should have resisted it,there are too many strings attached and too much monoply.

    People's revolt is not very far…..a very casual little thing will instigate it.

    We cannot predict it…….all we can only say is people have enough of Civil Vs Martial rule.

    They do not believe in any crap.

    In the afternoon, Mahmood was invited to CIA headquarters at Langley, Virginia, where he told George Tenet, the CIA director, that in his view Mullah Omar, the Taliban chief, was a religious man with humanitarian instincts and not a man of violence! This was a bit difficult for the CIA officials to digest and rightly so as the Taliban’s track record, especially in the realm of human rights, was no secret. General Mahmood was told politely but firmly that Mullah Omar and the Taliban would have to face US Military might if Osama Bin Laden along with other Al-Qaeda leaders were not handed over without delay.     General Mahmood on September 13, 2001, was handed a formal list of the US demands by Mr. Armitage and was asked to convey these to Musharraf and was also duly informed, for the sake of emphasis, that these were “not negotiable.” Colin Powell, Richard Armitage, and the assisstant secretary of state, Christina Rocca, had drafted the list in the shape of a “non-paper”. It categorically asked Pakistan:

    Stop Al-Qaeda operatives coming from Afghanistan to Pakistan, intercept arms shipments through Pakistan, and end ALL logistical support for Osama Bin Laden.

    Give blanket overflight and landing rights to US aircraft.

    Give the US access to Pakistani Naval and Air Bases and to the border areas betweeen Pakistan and Afghanistan.

    Turn over all the intelligence and immigration information.

    Condemn the September 11 attacks and curb all domestic expressions of support for terrorism.

    Cut off all shipments of fuel to the Talibans, and stop Pakistani volunteers from going into Afghanistan to join the Taliban. Note that, should the evidence strongly implicate Osama Bin Laden and the Al-Qaeda Network in Afghanistan, and should the Taliban continue to harbour him and his accomplices, Pakistan will break diplomatic relations with the Taliban regime, end support for the Taliban, and assist the US in the aforementioned ways to destroy Osama and his network.

    Mahmood then faxed the document to Musharraf. While the latter was going through it and in the process of weighing the pros and cons of each demand, his aide de camp that Colin Powell was on the line. Musharraf liked and respected Powell, and the conversation was not going to be a problem. He told him that he understood and appreciated the US position, but he would respond to the US demands after having discussed these with his associates.     At least then — not sure about now — the court could see through these tactics and the fact that they were a blatant violation of one of the cardinal rights guaranteed to citizens under the constitution and by the law — the writ of habeas corpus — and kept on asking the government for answers.     In 1981, the criminal BCCI bank sets up a charity called the BCCI Foundation. Pakistani Finance Minister Ghulam Ishaq Khan grants it tax-free status, and it supposedly spends millions on charitable purposes. Khan serves as the chairman of the foundation while also running the books for A. Q. Khan’s Kahuta Research Laboratories. Ghulam Ishaq Khan will be president of Pakistan from 1988 to 1993. [LEVY AND SCOTT-CLARK, 2007, PP. 126-127] BCCI founder Agha Hasan Abedi announces that he will donate up to 90% of BCCI’s profits to charity through the foundation, and he develops a positive reputation from a few well-publicized charitable donations. But the charity is actually used to shelter BCCI profits. Most of the money it raises goes to A. Q. Khan’s nuclear program and not to charitable causes. For instance, in 1987 it gives a single $10 million donation to an institute headed by A. Q. Khan. Millions more go to investments in a front company owned by BCCI figure Ghaith Pharaon. [BEATY AND GWYNNE, 1993, PP. 290-291] An investigation by the Los Angeles Times will reveal that less than 10% of the money went to charity.     The daughter, Kausar Khan, was taken to the local police station, although, contrary to usual practice, she was neither signed in nor signed out. The Dutch agents wanted to know why she had not opened the letter and whether she knew what was in it. She didn’t; she had merely been asked to look after it. Inside the envelope was a copy of a letter that Pakistan did not want to reach the West. The feared Pakistani Inter-Services Intelligence (ISI) had found the letter when they searched Dr AQ Khan’s home in Islamabad. He had also passed a copy on to his daughter Dina to take to her home in London, as rumours of Khan’s “proliferation” — jargon for the dissemination of nuclear secrets — swept the world. The Pakistani ISI were furious. “Now you have got your daughter involved,” they reportedly said. “So far we have left your family alone, but don’t expect any leniency now.”

    ماضی میں نہ تو کبھی ایسا ہوا اور اگر کہیں کوئی احتجاج ہوا بھی تو حکومت نے اسے درخور اعتناء نہیں سمجھا کیونکہ اس سے پہلے زیادہ تر امریکی امداد فوجی حکومتوں کو عطا ہوئی جنہیں اقتدار میں آنے کے لیے عوامی مینڈیٹ کی کبھی ضرورت ہی نہیں پڑی۔

    آئیے ذرا تاریخ پر نظر ڈالیں:

    امریکہ نے پاکستان کی امداد کے لیے پہلا معاہدہ 1954ء میں کیا تھا جس کے تحت پاکستان نے اگلے دس سالوں کے دوران تین ارب بیس کروڑ ڈالر امریکی امداد حاصل کی۔ امداد کا بڑا حصہ ملک کے پہلے فوجی حکمران جنرل ایوب خان کے دور میں ملا۔

    اس معاہدے کے تحت امریکی فوج نے راولپنڈی میں واقع پاکستان فوج کے ہیڈ کوارٹرز میں اپنا فوجی امدادی مشاورتی گروپ قائم کرکے فوج کے لیے ملٹری اسسٹینس پروگرام (میپ) شروع کیا تھا۔ امریکہ کے اس پروگرام میں پاکستان کی فوج کے یونٹوں کو میپ اور نان میپ یونٹوں میں تقسیم کیا گیا تھا۔

    نان میپ یونٹ وہ تھے جو کشمیر اور مشرقی پاکستان (موجودہ بنگلہ دیش) میں تعینات تھے۔ 1954ء کے معاہدے کے تحت امریکہ نے صرف میپ یونٹوں کی امداد کرنا تھی اور اس کا مقصد ان یونٹوں کی جدید خطوط پر تربیت کرنا بتایا گیا تھا۔

    اسی معاہدے کا ایک اور اہم پہلو یہ تھا کہ اسکے بعد جنرل ایوب خان نے امریکہ کو پاکستان میں اپنا پہلا خفیہ فوجی اڈہ قائم کرنے کی اجازت دی تھی۔ پشاور میں قائم اس فوجی اڈے کے ذریعے امریکی حکام حریف ملک سوویت یونین کی دفاعی تنصیبات کی خفیہ نگرانی کرتے تھے اور اس مقصد کے لیے مشہور امریکی یو ٹو طیارے استعمال ہوتے تھے۔

    پاکستان کے اس وقت کے وزیر خارجہ ذوالفقار علی بھٹو نے 1959ء میں اس اڈے کا دورہ کرنے کی خواہش ظاہر کی تھی تو امریکی بیس کمانڈر نے جواب دیا تھا کہ وزیر موصوف کو (اڈے کے) کیفے ٹیریا کا دورہ کرنے پر خوش آمدید کہا جائے گا وہاں انہیں کافی اور سینڈویچ بھی پیش کیے جائیں گے۔

    امریکہ نے 1960ء میں اپنے اس خفیہ اڈے کی موجودگی کا اعتراف اس وقت کیا تھا جب سوویت یونین نے اسی اڈے سے پرواز بھرنے والے ایک یو ٹو طیارے کو مار گرایا تھا اور اسکے پائلٹ کو گرفتار کرلیا تھا۔ اس واقعے کے بعد ہی امریکہ کو بغیر پائلٹ کے اڑنے والے ڈرون طیارے بنانے کا خیال آیا۔

    1954ء میں ہوئے امریکی امداد کے اس پہلے معاہدے کے خلاف مشرقی پاکستان میں کئی احتجاجی مظاہرے ہوئے تھے اور وہاں کی صوبائی اسمبلی کے 162 ارکان نے اپنے دستخطوں سے ایک بیان جاری کیا تھا جس میں اس معاہدے کی شدید مخالفت کی گئی تھی۔

    1965ء میں پاکستان اور بھارت کے درمیان جنگ کے بعد امریکہ نے دونوں ملکوں کی امداد میں بڑی حد تک کمی کردی تھی۔ 1979ء میں پاکستان میں جوہری پلانٹ کی موجودگی کے انکشاف کو جواز بناکر امریکی صدر جمی کارٹر کی انتظامیہ نے خوراک کے سوا پاکستان کی تمام امداد روک دی لیکن اسکے بعد افغانستان میں سوویت یونین کی فوجوں کے داخلے کے بعد پاکستان کی امداد نہ صرف بحال کردی گئی بلکہ اس میں تیزی سے اضافہ کیا جس کا اس وقت کے مارشل لاء ایڈمنسٹریٹر جنرل ضیاء الحق نے اپنے آمرانہ اقتدار کو قائم رکھنے کے لیے مؤثر طور پر استعمال کیا۔

    امریکہ نے افغانستان سے سوویت یونین کی فوجوں کو نکالنے کے لیے مجاہدین کی تربیت اور اسلحے کی فراہمی کے لیے دل کھول کر مدد کی اور 1980ء سے 1990ء کے دوران جنرل ضیاء الحق کی حکومت کو مجموعی طور پر پانچ ارب ڈالر کی رقم دی۔

    افغان جنگ کے دوران ہی جب امریکی انتظامیہ پاکستان کی فوجی حکومت کے لیے بھاری رقوم بھیج رہی تھی، امریکہ کے اندر پاکستان کے جوہری پلانٹ پر پائی جانے والی تشویش کا ایک نتیجہ یہ نکلا کہ کانگریس نے امریکہ کے غیرملکی قانون میں ایک ترمیم کی منظوری دے دی جسے پریسلر ترمیم کا نام دیا گیا۔

    ریپبلکن پارٹی کے ایک سنیٹر کے نام سے منسوب اس ترمیم کے تحت امریکی صدر کو پابند کیا گیا کہ وہ ہر سال امداد دینے سے پہلے اس بات کی تصدیق کریں گے کہ پاکستان جوہری ہتھیار تیار نہیں کررہا۔

    پریسلر ترمیم کے تحت امریکی صدر 1989ء تک اس بات کی تصدیق کرتے رہے کہ پاکستان کے پاس جوہری ہتھیار نہیں بنارہا اور اسکے نتیجے میں پاکستان کو امداد ملتی رہی لیکن 1990ء میں اس وقت کے صدر جارج ایچ ڈبلیو بش نے یہ تصدیق کرنے سے انکار کردیا کہ پاکستان جوہری بم نہیں بنارہا جس کا فوری نتیجہ یہ ہوا کہ پاکستان کی زیادہ تر معاشی اور تمام فوجی امداد معطل ہوگئی اور امریکہ نے پاکستان کے خریدے ہوئے ایف سولہ طیاروں کی فراہمی بھی روک دی۔

    1991ء سے 2000ء تک وقتاً فوقتاً جو امداد ملی اس کی مجموعی مالیت 50 کروڑ ڈالر تھی۔

    گیارہ ستمبر 2001ء کے حملوں کے بعد امریکی ترجیحات بدلیں تو پاکستان میں دو سال پہلے منتخب حکومت کا تختہ الٹ کر آنے والی ایک اور فوجی حکومت اپنے قدم جماچکی تھی۔ جنرل پرویز مشرف کے پہلے پی سی او کے تحت حلف اٹھانے والی نہ صرف ایک نئی عدلیہ آگئی تھی اور اس نے ان کے فوجی انقلاب کی حمایت کرنے کے ساتھ ساتھ انہیں آئین میں ترمیم کرنے کی مشروط طور پر اجازت بھی دے دی تھی۔

    جارج ڈبلیو بش کی انتظامیہ نے ایک بار پھر پاکستان کی فوجی حکومت کے لیے امداد بحال کردی۔ امریکہ نے جنرل پرویز مشرف کی فوجی حکومت کو مجموعی طور پر گیارہ ارب ڈالر دیے جس میں آٹھ ارب ڈالر فوجی امداد کی مد میں دیے گئے

    Pakistan is struggling. We have over 170 million people. Roughly 2/3 of this population which means 113 million Pakistani's live under 160rs day. Pakistani's like you and me do not require this aid. It is the slums in Karachi, the open sewer in Lahore, the open stove in Quetta and the required roof over the house in Peshawar that desperately need this aid money. This aid money if utilized smartly, can have a multiplier effect for our Human Development Index (HDI). The language in the Bill poses a problem. We need to rectify it it, not reject it. Read my article to get a different perspective to all the hate which is spewing out of control.

    Come to the basic again.The question Amjad Malik asked was simple.

    As per the views and sentiments on the TV shows and news etc it seems Pakistanis are against the bill.

    The PPP champion of Democracy wants to have this bill got into action despite the reservation expressed by the army and by the people.

    Now the MILLION DOLLAR Question is:People who desperately are struggling for Democracy does not support Kerry Lugar bill which would clip the wings of millitary?

    The Conclusion is CONGRATULATIONS PAKISTAN.We would not be dictated or fooled by anyone in any name.

    We do not want army to interfere with Politics but we want them to check the Interests and borders of the country.

    We want the civilian governmet but we would not give them a free hand to deal with anything without our consent.

    This is pure politics controlled by people …….Deliverance cannot be very far.

    our leadership has been faied in presenting the case of extrimism and rerrorism to the world because the so called war on torror is not our own war but it is imposed forcefullu on us,america is giving more than 60 billions every year to afghanistan without any conditionalities but for pakistan which is most effected they are giving only 1.5 billions and also imposing many restriction over there,,i think its not an aid but an agreement of selling the soverignity of pakistan……..why we adore mahmud ghaznavi,tipu sultan and aziz bhatti not because they were the great producers of food stuff but they were the signs of grace and symbols of sacrifice….as an egoistic naion we should refuse this bill because we accept everything but will never accept the slavery of others,……..
