K-L Bill – Yes or No?

Kerry Lugar Bill‘Do you know why these suicide attacks are suddenly one the rise again?’ asked my friend. ‘No, but I guess you have a reason to justify them’ I replied in a cold manner, wondering when did the attacks actually slowed down.

‘Yes I know it is because of the Kerry Lugar bill. You know, these people (read: agents) are attacking our institutions and people to prove that we are in such poor condition that we cannot survive without aid’.

No doubt this Kerry-Lugar bill aka Killer-bill has become quite the talk of the town and people are now blaming the bill for our basic problems such as the electricity issue without realizing what the bill actually aims at.

On Sept 24, the US Senate unanimously passed the revised version of the Kerry-Lugar Bill, titled the Enhanced Partnership with Pakistan Act 2009.

On Oct. 15th President Barack Obama signed the bill into law which will triple non-military US aid to Pakistan to $7.5 billion over the next five years and hence leaving no choice for Pakistan government to request for any amendments in the bill.

The only choice before us is to either fully accept it or reject it on the whole.

Despite the efforts of the Pakistan government to prove that the act would not harm Pakistan’s sovereignty but the fact remains that US government has rejected the concerns of Pakistan and sent back our Foreign Minister with an explanatory note, attached with the Enhanced Partnership with Pakistan Act of 2009.

Surprisingly, our Foreign Minister Mr. Shah Mahmood Qureshi called the explanatory statement “historic” and assured the Parliament on October 16 that no Pakistani authority had been conceded to benefit from the Kerry-Lugar bill. He extensively quoted from an explanatory statement that ‘there are no conditions on Pakistan attached to the authorisation of $7.5 billion in non-military aid’.

Critics say that while using harsh and loud words to get the support of the fellow parliamentarians, what our foreign minister failed to realize is that action speaks louder than words and the people are well aware that he had returned empty-handed from US and thus had to put up this show to save his neck. According to Mr. Anwar Baig (former senator and senior PPP member) the much publicised speech of Mr. Qureshi in the Parliament is ‘nothing but a brilliant piece of acting for which he should be nominated for Oscars.’

Apart from the government appraisal of the act, the main concern of the concerned ones still remain unanswered that why the controversial sections of the act are unaddressed by the Pakistan government.

For instance, Section 203 of the US law considers that Pakistan is involved in the proliferation of nuclear weapons-related materials although it has never been proven in a court of law. The section also presumes that Pakistan is somehow involved in sponsoring terrorism, and that Pakistan’s military and intelligence agencies are involved in aiding terrorist groups, including those groups engaged in attacks against the United States or coalition forces in Afghanistan, and against the territory or the people of neighbouring countries.

The act specifically mentions organizations such as Al-Qaeda, Lashkar-e-Taiba and Jaish-e-Mohammed and makes it clear that Pakistan is prohibited from letting them operate in its territory, including carrying out cross-border attacks into neighbouring countries. The law further requires the closure of terrorist camps in Fata and dismantling terrorist bases in other parts of the country, including Quetta and Muridke.

Then the message for the security forces of Pakistan is that it must not ‘materially’ and ‘substantially’ subvert the political or judicial processes of Pakistan.

Some other important concerns are, placing limitations on arms transfers; requiring that all assistance can only be provided to civilian authorities of a civilian government of Pakistan; (Sec. 205).

Other concern is regarding the submission of a Pakistan Assistance Strategy Report within 45 days of the date of enactment of the act; development of a comprehensive inter-agency regional security strategy to eliminate terrorist threats and close terrorist safe havens in Pakistan, including by working with the Government of Pakistan and other relevant governments and organisations in the region and elsewhere to implement effective counter-insurgency and counter-terrorism efforts in and near the border areas of Pakistan and Afghanistan, including Fata, the NWFP, parts of Balochistan and parts of Punjab(Sec. 301. Strategy Reports) and the submission of monitoring reports with description of all amounts made available for assistance to Pakistan during fiscal year 2009, including a description of each program, project, and activity for which funds were made available (Sec. 302. Monitoring Reports).

Although the above stated law may seem like a country’s internal matter but this all has been stated in the US law as if the US is dictating and teaching us the laws to run a terrorist-free country. It appears that this does not like an attack on Pakistan’s sovereignty to our government.

In the end we must realize that it is all a game of interest and of course nobody is willing to help you for free. The US law-makers have clearly stated their policy regarding Pakistan and have laid down their interests in the form of Enhanced Partnership with Pakistan Act 2009. It is time now that we decide and point out our national interests loud and clear.

    Several serious political issues have taken over the media and garnered national attention over the past few weeks. These include President Zardari’s trip to the United States, the Punjab government requesting a delay in the by-poll elections the bomb blast at the World Food Program UN office in Islamabad and of course, the Kerry-Lugar Bill seems to be leading in the popular vote. The question is, with immense opposition brewing and the government allowing an open debate in the National Assembly, will we be able to find a viable solution?

If you are making a point that the US played its part in the rise of fundamentalism I have no quarrel with that. But you are clearly implying in your posts that these acts of terrorism are being somehow masterminded by the Americans, and when I ask for proof you point to a ridiculous statement from a known terrorist! btw the recent attacks in Lahore were clearly claimed by the taliban, even they realize there is no point in denying their involvement any more.

    My posts were meant to highlight a point that USA cannot absolve itself from this Terror Menace in Pakistan. And, yeas they are all American Agents.

    Why the US Government tolerated this menace when the very favourite pet of USA i.e. Former Chief of Army Staff Pervez Musharraf allowed this:

    " And while the Sipah-e-Sahaba Pakistan and the Lashkar-e-Jhangvi stand officially disbanded, their most militant son and leader, Maulana Azam Tariq, an accused in several cases of sectarian killing, contested elections from jail – albeit as an independent candidate – won his seat, and was released on bail shortly thereafter.     And this takes me back to Pervez Musharraf’s first visit to the US after his coup. At a meeting with a group of journalists among whom I was present, my dear and much lamented friend Tahir Mirza, then the Dawn correspondent, asked Musharraf why he was not acting against Lashkar-e Tayba and Jaish-e Muhammad. Musharraf went red in the face and shot back, “They are not doing anything in Pakistan. They are doing jihad outside.”

    Just curious. Would you like to tell me as to how it was possible that several Radio Stations were successfully operating by Mullahs in Tribal Area and that too during General Musharraf's First Operation against Mullahs in Tribal Areas. Point that is to be noted that during Musharraf's Tenure several FM Channels [in settled area] were not allowed to operate by the same Musharraf.

    How many dead bodies of Terrorists were seen by media particlarly of those alleged Terrorists who are supposedly killed in action.

    When no agency can trace the Most Wanted Thugs of Tribal Area then how it was possible for the media to 'interview' them successfully.

    Many in Pakistan fail to understand the value of their vote. Agreed we go to the polling stations whenever we are lucky enough to have elections, but having an ink mark on our thumb does not mark the end of our civic duty. When we come out in numbers, those politicians that take Pakistanis for granted are shaken to the core. Those law enforcement agencies carry out their duty with justice. Not only the government, but the army also realizes that it becomes powerless when it is dealing with the nation as one. If we, the people, are able to wield such influence over these powerful institutions by coming together as one unit, lord save the militants if we truly unite as Pakistan.

    The fear of an Islamic threat has been the driving force behind most Western countries’ foreign policies toward Pakistan in recent years. The possibility that violent Islamists will kill President Pervez Musharraf, throw Pakistan into turmoil, take over the country and its nuclear weapons, and escalate regional terrorism has dominated the psychological and political landscape. Such fears have usually led to support of the Pakistani military as the only institution able to contain the danger. But the Islamist threat is neither as great nor as autonomous as many assume. True, Pakistan has experienced more than its share of religious violence, both sectarian and jihadi. But serious law-and-order problems do not mean the fate of the state is at stake. No Islamic organization has ever been in a position to politically or militarily challenge the role of the one and only center of power in Pakistan: the army. On the contrary, the Pakistani Army has used Islamic organizations for its purposes, both at home and abroad. Islamist organizations balance the power of rival mainstream political parties, preserving the army’s role as national arbiter. The army has nurtured and sometimes deployed violent Islamists in Afghanistan (with U.S. support at first), Kashmir, and other hot spots on the subcontinent.

    i read the most interesting conversation taking place between two gentlemen here…if i may call them that…there two things that I wish to say:

    1. I am a student of IIUI. our university was rocked by two bomb blasts on the 20th of october 2009. just 3 days ago or 2 rather…

    our uni as its name clearly mentions is"islamic". our classes and buildings are segregated, we have no concerts on our premises…our transport facilities are seperate…everything the Taliban way…if u may call it that (I dont)….the point is if the culprits behind teh terror attacks were Talibans why would they attack us?…i see no reason at all…rather their target could have been one of the countries alrge co-eduactional institutions…but what gets attacked? "a ladies-only cafe and the shariah and law department" of IIUI….

    is it still not clear to u Mr.DC?

    WASHINGTON, Oct 23: The US military is providing intelligence and surveillance video from unmanned aircraft to the Pakistani army to assist it in its week-old offensive in South Waziristan, according to the Los Angeles Times.

    US officials who spoke to the newspaper said this was “the deepest American involvement yet in a Pakistani military campaign”. US Air Force Predators were providing overhead video — and possibly radio intercepts — for the Pakistani campaign, the daily said on Friday. Pakistan combines the data with the information it receives from its sources on the ground in locating militant hideouts in the region.

    “Pakistan has superior human intelligence on the ground, where its powerful Inter-Services Intelligence has cultivated networks of informants among militant groups. But the government has a limited ability to intercept cell phone calls and other transmissions,” the Times noted. “Any type of imagery would be of use to the Pakistanis, either from Predator or other means,” a senior US Defence official told the newspaper. In particular, Pakistan has sought intelligence “on locations of the enemy, re-supply routes, re-supply activity . . . in real time.”

    The Times reported that for at least a year, the American and Pakistani militaries had tried to figure out the best way to share the intelligence that the unmanned aircraft gathered. At first, Pakistani officials publicly denied that there was any cooperation. Then Google Earth images showed US Predators parked on a Pakistani runway. The intelligence sharing showed “how the Obama administration intends to intensify pressure on insurgents in Pakistan as the administration overhauls the US military strategy in neighbouring Afghanistan”, the report noted. The cooperation also reflects a significant shift for Pakistan, which had previously resisted US offers to deploy Predators in support of its military operations.”

    What is behind the ‘Ghairat’ debate? Wednesday, October 14, 2009 By Sadiq Saleem

    The Jamaat-e-Islami was too busy opposing the creation of Pakistan to notice that in November 1947 Quaid-e-Azam sent Mir Laik Ali (of Hyderabad Deccan) to Washington to ask for $2 billion in aid from the Americans. Pakistan, however, only received $10 million, only 0.5% of the original request.

    The fathers and grandfathers of most of the Pakistan Muslim League leaders (both N and Q) were in Pakistan Muslim League Convention when Field Marshal Ayub Khan secured large amounts of aid to build Pakistan’s Air Force (which saved our neck in 1965), create the agricultural revolution and build huge projects like the Mangla and Tarbela Dams.

    All of Ayub’s social and economic achievements were because of American aid, which always brings other aid. Aid from the World Bank and other institutions for many projects including the Indus waters system were amongst the many benefits at that time. Had ‘Ghairat’ trumped aid, we would be short of a lot more than what we face today.

    We are lucky that Brigadier Imtiaz Billa and Lt Gen Hamid Gul were still in service and Irfan Siddiqi and Haroonur Rashid had not yet become as influential as they are today during the rule of Ziaul Haq when we got massive amounts of aid enabling us to build huge airports, secure F-16s and covertly build the nuclear programme. Had their slogan mongering of today been national policy in the 1980s even the ISI would not have become the formidable intelligence service it has become because, after all, that all happened because of US assistance.

    If ‘Ghairat’ had been such an issue during General Zia’s period then our anchors would have been screaming each time Zia drove himself in his car to meet the American ambassador in complete violation of protocol, as reported in Lt Gen KM Arif’s book. But no one can dare question the patriotism of a coup-making four-star general. It is only civilians who are periodically suspect.

    Another recent addition to the ‘Ghairat’ lobby, former ISI chief Lt Gen Javed Ashraf Qazi was happy to be Minister of Railways in Musharraf’s era, gladly spending the money coming in as US aid. He did not bother to read the terms of American aid provided in 2001 and 2007 that included humiliating and insulting certification that Pakistan “had closed all known terrorist camps operating in Pakistan and Pakistan occupied Kashmir.”
