Except governorm Punjab malaoon Salman Taseer….

Did you ever hear of a high level sitting official condemning the law of his state?

Did you ever see a high level official held a press conference in the jail for a convicted criminal?

Do you ever learn a lesson?

But this law was imposed by a usurper Zia who violated the Constitution and declared himself like Firoun "Ana rabbakamulaahlah" (I am your Chief Executive). In any case every body has a right to criticize what he considers a bad law, but the right of legitimate use of force lies with the State.

Lets not forget it was Jinnah and Iqbal who cheered the assasin originally! They justified, glorified and defended ghazi illmideen. They left the precedent for this act.

Its strange no one who condemns those who cheer this murder have the intellectual honesty to condemn jinnahs and iqbal cheering of that murder.

So you debate along the lines "they did it" – so "we can do it" – whats wrong is wrong, two wrongs do not make a right – my contention is the right to take someones life should never be at the hands of people – no matter how holy the issue may be, the right rests with the supreme head of the state

      No teethmaestro,

I am not saying that at all. What I am saying is that I see a lot of posts condemning those who instigated this. Yet they would not condemn jinnah and iqbal for it.

Since my school years I still remember classes of urdu and iqbal poetry where ghazi illmidins incident was described and glorified.

My question is why are we do two faced and dishonest. If this is wrong then say that jinnah and iqbal were wrong too. At least be honest and consistent. having read you for years, I think you are one of those people who would indeed say they were wrong if you believed it. But most people I know would not do that. I would really be curious if people like mr. hussain would say the same thing about jinnah and iqbal that they say about the other cheerers of the murder. Thats my question and point. Do you mind asking him?

"Its strange no one who condemns those who cheer this murder have the intellectual honesty to condemn jinnahs and iqbal cheering of that murder."

No dear much have been said against Iqbal and Jinnah for supporting the lynch culture instigating people like Ilam DIn and the ilk, but when one becomes an icon, especially an islamic one, all criticism against him is suppressed. However there are some extenuating circumstances for Jinnah's appearance just as a lawyer in the appeal of ID in High court as he had denied having committed the murder at the trial stage. As for Iqbal, no doubt his poetry is full of material inspiring the muslims for jihad, but it no way meant lynching people like a vigilante.

I could not believe my ears hearing people on the TV saying that if there was a problem, a FIR should have been filed against salman taseer for blasphemy.

LOL, like the supreme court has been able to reopen swiss cases against Zardari, like eveyone in the PPP with NAB cases have been pursued and punished.

In a country which is only for the rich and powerful and no justice where the rich can get away with anything, one has the audacity to tell the poor man, you go through the courts chum.

Its like a rich man saying, Here let me rape your wife, daughter and kill them. Ok, now you have no right to kill rich powerful me. Its against islam. Go file an FIR in the police which I own. You have to follow the system you silly sucker. You cannot take law into your own hands.

This whole bloody system is exactly for that. The powerful can do what they want and control the system so they cannot be accountable. We are all supposed to sit down and be stupid morons and accept it.

I have a few simple questions for the people who are backing "ghazi" Qadri.. The following questions are for the understanding of all those (like myself) who don't really understand what wrong Salman Taseer did exactly.

    1. What is blasphemy law in Pakistan? What is the definition of blasphemy according to that law?

For reference: Blasphemy law in Pakistan are part of Pakistan Penal Code, originally written by British (in 1860) to prevent inter-religious conflict. The law was amended in 1985 and later.

    2. What are the sources of Islamic law (Shariah)? As per majority of schools of thought, they are Quran, Sunnah, Ijmah and Qiyas.

    3. What did Salman Taseer exactly say that comes under blasphemy? Saying Pakistan Panel Code §295-§298 should be reviewed can either be: a) request for ijmah by law makers, b) saying (british made) Pakistan panel code is not clear enough. Hadood ordinance was amended in 2006 under Women protection bill, was that blasphemy too?

For reference: §295-C is the law that says blasphemy of Prophet SAW is non-bailable, punishable by death (added 1986).

By the way, the law is "cognizable", meaning Police can register direct criminal case, initiate the investigation and arrest the accused without interference of the court. The process of the registration of the criminal case, investigation, arrest of the accused and other relevant proceedings lie with the whims and caprice of Police officials.

    4. What did Aasia Bibi actually say? Who were witnesses? What are the details of the case?

    5. Can an individual take law in own hands (even in an Islamic state)? What is the difference between justice and creating fitnah?

    1. Dr.Jawwad Khan Avatar

      @ Ali,

I don’t think that i need to answer the question No.1 & 2 as these questions are rhetorical question. Every one knows the blasphemy law and sources of Islami Shariyah.

For question No.3, I think you should ask for yourself.Every one has a right to disagree with the procedures, legal formalities and requirement under any law but saying that blasphemy law is a “black law” provides us a clear answer of the intentions..for me malaoon Salman taseer took one step further than Asia bibi. The most logical interpretation of this statement is that Malaoon Salman Taseer wanted to open the gates of blasphemy inside Pakistan in the name of freedom of expression and tolerance. I think that is enough to make him wajib ul qatal.

Question No.4: The true answer is that I don’t know because I am not a right person to answer these question and because I am sitting thousands of miles away from the incident. I think you should ask this question to “talibani” Investigation officer or “talibani” judge…however there are some facts which one should not forget

      1) She was arrested, investigated and convicted by court of law.

      2) She did not denied the charges or said that these claims are false according to investigation officer. She filed a mercy petition…which means??? ask lawyer

Question No.5) Why didn’t you ask the same question to yourself? Were you disgusted when a high ranking state official and sitting governor said that the blasphemy law is black law?

Can you give me one example from any where in the world when a high ranking state official passed these kinds of remarks against the law?

Do you know any high ranking govt official who visited a convicted criminal in a jail and held a press conference inside the jail side by side of the convicted and said that the convicted is suffered because our law is a black law?

Instead of follow through the laws and go to the higher courts…a malaoon governor took a signature on her mercy petition without being approached by any of her relatives….

when you put the justice on the tip of your shoes fitnah will be created without any effort.

    @Dr. Javed:

Questions 1 and 2 are not rhetorical questions. §295-C is the law that says blasphemy of Prophet SAW is non-bailable, punishable by death (added 1986).

Salman Taseer said this amendement is a "black law". What i do no understand is:

    a. The entire law body was made by British in 1860. §C was added by the ruler of the time. Isn't it open to questioning? If not why? If it has been misused and called a black law, how does that exactly qualify as blasphemy? The law was neither a word of Prophet SAW, nor part of Hadith, nor is it part of a code of Shariah. It's simply PAKISTAN PENAL CODE §295.

    b. Previously, there has been debate and modifications to Hadood ordinance, which was also called black ordinance by several people. Is that Blasphemy too?

    c. Salman Taseer repeatedly said that blasphemy should be punished HOWEVER the way the law is implemented and worded, it's been misused and should be discussed and debated. How does that open doors of blasphemy? That closes doors for misuse of a law, at worst.

    d. If you see blasphemy law details, and some proponents arguments, it says that regardless of what the individual says, the penalty is death. The law prohibits even the witness to say exactly what the accused has said and if no one says what's exactly being said how can any justice be done – especially when it's a question of life and death. In Saudi Arab, if you are accused of blasphemy and you apologize, you are indeed forgiven and there have been cases where individuals have been forgiven or letoff with minor punishments (compared to death). If other countries, Saudia Arab, Malaysia etc. can have variation of the law, why can't we? Aasia Bibi did deny that she said anything blasphemous. In fact, the details in newspaper are that some of her friends wanted to convert her to Islam. It led to arguments and they complained to a local maulvi that Aasia had passed blasphemous remarks which led to an FIR lodged and as you can see above the law is "cognizable", so it can obviously been misused and it was misused. Similarly, there was another case, where a doctor was accused by a pharmacy sales person for blasphemy because his visiting card was thrown in dustbin and it had "Muhammad" written on it. Again, there are numerous examples of such misuse of the law.

    e. I am not disgusted when governor calls a law black law because it's a parlimentary question. Parliment made the law, can debate over its implemenntation and details and can change it or not. I can say the entire Pakistan Panel Code is black Panel code made by British to subjugate Indian sub-continent, how does that show that I have any less respect and love for my Prophet SAW than you or anyone else do?

What I want to understand is – like many other people like myself – what exactly did Salman Taseer do wrong? How can others like us avoid doing the same wrong thing (not because we are afraid of being targeted by an individual but because we want to keep our Allah and Prophet SAW happy so that when we face them on day of judgement we are answerable for our actions)? As they say, if you see something wrong, stop it with action, or words or think of it as wrong in your heart.

It could be that there are no right answers, Salman Taseer was right in questioning the implementation of law and his murder has highlighted the fact that we are a nation are divided, which is fine. Either supporters of Salman Taseer are creating fitnah or opponents. Only Allah will decide that. I know for a fact that you, I and all of us will be questioned on the stances we take, research we do, and how much we strive to find the truth – especially as educated people. So if you make up your opinion about Aasia Bibi without knowing details, and based on that opinion approve of a "murder", you are a supporter of a "murderer". If I oppose a "Ghazi" without knowing the details, I am a Fitnah creator too. Neither one of us want to go to Hell, so why not try to find out what the facts are and stop believing in what we are being told? Unless of course, one of us is indeed a Fitnah supporter (consciously or unconsciously), in which case, may Allah help us.

    @Dr. Javed,

Some responses I believe I should give (as per my understanding, Allah knows best):

    (a) She filed a mercy petition…which means??? ask lawyer

    > It means she is asking for mercy. Just like any subjugated person would. "Please have mercy on me. Don't implicate me in something I have not done."

    > Why don't you ask yourself what asking for mercy means?

    (b) Question No.5) Why didn’t you ask the same question to yourself? Were you disgusted when a high ranking state official and sitting governor said that the blasphemy law is black law?

    > Already answered above in last post.

    (c) Can you give me one example from any where in the world when a high ranking state official passed these kinds of remarks against the law?

    > Of course. Several, from US (law makers joining protestors to protest against immigration laws) to Maldives where MPs protested against a proposed law to give women equal rights in marriage.

    (d) Do you know any high ranking govt official who visited a convicted criminal in a jail and held a press conference inside the jail side by side of the convicted and said that the convicted is suffered because our law is a black law?

    > As of right now I don't. However, why can't Governor of a province visit jail and voice his opinion as per the framework I mentioned above in the last message? The request for a prior example does not add any value to your argument.

    (e) Instead of follow through the laws and go to the higher courts…a malaoon governor took a signature on her mercy petition without being approached by any of her relatives….

    > So what are you against: that he listened to her mercy plea (while saying he cannot do anything, he will pass it on to the President who has the right to decide), OR that he did it without her relatives asking for help (does a just ruler need to be asked to help before he helps his subjects?) Please elaborate what you are trying to say here and how it's illegal from Shariah or our legal system point of view.

    (f) when you put the justice on the tip of your shoes fitnah will be created without any effort.

    > Indeed.By the murder of Salman Taseer, the seeds of Fitnah are already planted. You, I and us just need to ensure, we are not part of that Fitnah – and we need to see which side is really Fitnah and which side isn't.

I ask who is a believer?

    From tafseer ibn kathir

    =================

One Does not Become a Believer Unless He Refers to the Messenger for Judgment and Submits to his Decisions

    Allah said,

(But no, by your Lord, they can have no faith, until they make you judge in all disputes between them,) Allah swears by His Glorious, Most Honorable Self, that no one shall attain faith until he refers to the Messenger for judgment in all matters. Thereafter, whatever the Messenger commands, is the plain truth that must be submitted to inwardly and outwardly. Allah said,

(and find in themselves no resistance against your decisions, and accept (them) with full submission.) meaning: they adhere to your judgment, and thus do not feel any hesitation over your decision, and they submit to it inwardly and outwardly. They submit to the Prophet's decision with total submission without any rejection, denial or dispute. Al-Bukhari recorded that `Urwah said, "Az-Zubayr quarreled with a man about a stream which both of them used for irrigation. Allah's Messenger said to Az-Zubayr,

    «اسْقِ يَا زُبَيْرُ ثُمَّ أَرْسِلِ الْمَاءَ إِلى جَارِك»

(O Zubayr! Irrigate (your garden) first, and then let the water flow to your neighbor.) The Ansari became angry and said, `O Allah's Messenger! Is it because he is your cousin' On that, the face of Allah's Messenger changed color (because of anger) and said,

    «اسْقِ يَا زُبَيْرُ ثُمَّ احْبِسِ الْمَاءَ حَتَّى يَرْجِعَ إِلَى الْجَدْرِ،ثُمَّ أَرْسِلِ الْمَاءَ إِلى جَارِك»

(Irrigate (your garden), O Zubayr, and then withhold the water until it reaches the walls (surrounding the palms). Then, release the water to your neighbor.) So, Allah's Messenger gave Az-Zubayr his full right when the Ansari made him angry. Before that, Allah's Messenger had given a generous judgment, beneficial for Az-Zubayr and the Ansari. Az-Zubayr said, `I think the following verse was revealed concerning that case,

(But no, by your Lord, they can have no faith, until they make you (O Muhammad ) judge in all disputes between them.)''' Another Reason In his Tafsir, Al-Hafiz Abu Ishaq Ibrahim bin `Abdur-Rahman bin Ibrahim bin Duhaym recorded that Damrah narrated that two men took their dispute to the Prophet , and he gave a judgment to the benefit of whoever among them had the right. The person who lost the dispute said, "I do not agree.'' The other person asked him, "What do you want then'' He said, "Let us go to Abu Bakr As-Siddiq.'' They went to Abu Bakr and the person who won the dispute said, "We went to the Prophet with our dispute and he issued a decision in my favor.'' Abu Bakr said, "Then the decision is that which the Messenger of Allah issued.'' The person who lost the dispute still rejected the decision and said, "Let us go to `Umar bin Al-Khattab.'' When they went to `Umar, the person who won the dispute said, "We took our dispute to the Prophet and he decided in my favor, but this man refused to submit to the decision.'' `Umar bin Al-Khattab asked the second man and he concurred. `Umar went to his house and emerged from it holding aloft his sword. He struck the head of the man who rejected the Prophet's decision with the sword and killed him. Consequently, Allah revealed,

(But no, by your Lord, they can have no faith).

Since the other ali mentioned fitna here… (hey I was the orginal ali in the comments before the other ali showed up), interesting to note the ayat most often quoted about fasad and fitna on Pakistani TV. I got curious and looked in up in tafseer ibn kathir. Read it and THINK!

    —————————————————-

    Meaning of Mischief

In his Tafsir, As-Suddi said that Ibn `Abbas and Ibn Mas`ud commented,

(And when it is said to them: "Do not make mischief on the earth,'' they say: "We are only peacemakers.'') "They are the hypocrites. As for,

("Do not make mischief on the earth''), that is disbelief and acts of disobedience.'' Abu Ja`far said that Ar-Rabi` bin Anas said that Abu Al-`Aliyah said that Allah's statement,

(And when it is said to them: "Do not make mischief on the earth,''), means, "Do not commit acts of disobedience on the earth. Their mischief is disobeying Allah, because whoever disobeys Allah on the earth, or commands that Allah be disobeyed, he has committed mischief on the earth. Peace on both the earth and in the heavens is ensured (and earned) through obedience (to Allah).'' Ar-Rabi` bin Anas and Qatadah said similarly.

Types of Mischief that the Hypocrites commit

Ibn Jarir said, "The hypocrites commit mischief on earth by disobeying their Lord on it and continuing in the prohibited acts. They also abandon what Allah made obligatory and doubt His religion, even though He does not accept a deed from anyone except with faith in His religion and certainty of its truth. The hypocrites also lie to the believers by saying contrary to the doubt and hesitation their hearts harbor. They give as much aid as they can, against Allah's loyal friends, and support those who deny Allah, His Books and His Messengers. This is how the hypocrites commit mischief on earth, while thinking that they are doing righteous work on earth.''

The statement by Ibn Jarir is true, taking the disbelievers as friends is one of the categories of mischief on the earth. Allah said,

(And those who disbelieve are allies of one another, if you do not do this (help each other), there will be turmoil and oppression on the earth, and great mischief.) (8:73), In this way Allah severed the loyalty between the believers and the disbelievers. Similarly, Allah said,

(O you who believe! Do not take disbelievers as Awliya' (protectors or helpers or friends) instead of believers. Do you wish to offer Allah a manifest proof against yourselves) (4: 144).

    Allah then said,

(Verily, the hyprocrites will be in the lowest depth of the Fire; no helper will you find for them) (4:145).

Since the outward appearance of the hypocrite displays belief, he confuses the true believers. Hence, the deceitful behavior of the hypocrites is an act of mischief, because they deceive the believers by claiming what they do not believe in, and because they give support and loyalty to the disbelievers against the believers.

If the hypocrite remains a disbeliever (rather than pretending to be Muslim), the evil that results from him would be less. Even better, if the hypocrite becomes sincere with Allah and makes the statements that he utters conform to his deeds, he will gain success. Allah said,

(And when it is said to them: "Do not make mischief on the earth,'' they say: "We are only peacemakers.'') meaning, "We seek to be friends with both parties, the believers and the disbelievers, and to have peace with both parties.'' Similarly, Muhammad bin Ishaq reported that Ibn `Abbas said,

(And when it is said to them: "Do not make mischief on the earth,'' they say: "We are only peacemakers.'') means, "We seek to make amends between the believers and the People of the Book. '' Allah said,

(Verily, they are the ones who make mischief, but they perceive not.). This Ayah means that the hypocrites' behavior, and their claim that it is for peace, is itself mischief, although in their ignorance, they do not see it to be mischief.

    (13. And when it is said to them: Believe as the people believe,'' They say: "Shall we believe as the fools have believed'' Verily, they are the fools, but they do not know.)

Allah said that if the hypocrites are told,

("Believe as the people believe,''), meaning, `Believe just as the believers believe in Allah, His angels, His Books, His Messengers, Resurrection after death, Paradise and Hellfire, etc. And obey Allah and His Messenger by heeding the commandments and avoiding the prohibitions.' Yet the hypocrites answer by saying,

("Shall we believe as the fools have believed'') they meant (may Allah curse the hypocrites) the Companions of the Messenger of Allah . This is the same Tafsir given by Abu Al-`Aliyah and As-Suddi in his Tafsir, with a chain of narration to Ibn `Abbas, Ibn Mas`ud and other Companions. This is also the Tafsir of Ar-Rabi` bin Anas and `Abdur-Rahman bin Zayd bin Aslam. The hypocrites said, "Us and them having the same status, following the same path, while they are fools!'' `The fool' is the ignorant, simple-minded person who has little knowledge in areas of benefit and harm. This is why, according to the majority of the scholars, Allah used the term foolish to include children, when He said,

(And do not give your property, which Allah has made a means of support for you, to the foolish) (4:5).

Allah answered the hypocrites in all of these instances. For instance, Allah said here,

(Verily, they are the fools). Allah thus affirmed that the hypocrites are indeed the fools, yet,

(But they know not). Since they are so thoroughly ignorant, the hypocrites are unaware of their degree of deviation and ignorance, and such situation is more dangerous, a severer case of blindness, and further from the truth than one who is aware.

    (14. And when they meet those who believe, they say: "We believe,'' but when they are alone with their Shayatin (devils), they say: "Truly, we are with you; verily, we were but mocking.'') (15. Allah mocks at them and leaves them increasing in their deviation to wander blindly.)

The Necessity of Taqwa and Avoiding Riba

Allah commands His believing servants to fear Him and warns them against what would bring them closer to His anger and drive them away from His pleasure. Allah said,

(O you who believe! Have Taqwa of Allah) meaning, fear Him and remember that He is watching all that you do.

(And give up what remains of Riba) meaning, abandon the Riba that people still owe you upon hearing this warning,

(if you indeed have been believers) believing in the trade that He allowed you and the prohibition of Riba. Zayd bin Aslam, Ibn Jurayj, Muqatil bin Hayyan and As-Suddi said that this Ayah was revealed about Bani `Amr bin `Umayr, a sub-tribe of Thaqif, and Bani Al-Mughirah, from the tribe of Bani Makhzum, between whom were outstanding transactions of Riba leftover from time of Jahiliyyah. When Islam came and both tribes became Muslims, Thaqif required Bani Al-Mughirah to pay the Riba of that transaction, but Bani Al-Mughirah said, "We do not pay Riba in Islam.'' `Attab bin Usayd, the Prophet's deputy on Makkah, wrote to the Messenger of Allah about this matter. This Ayah was then revealed and the Messenger of Allah conveyed it to `Attab,

(O you who believe! Be afraid of Allah and give up what remains (due to you) from Riba (from now onward), if you are (really) believers. And if you do not do it, then take a notice of war from Allah and His Messenger.)

They said, "We repent to Allah and abandon whatever is left of our Riba'', and they all abandoned it This Ayah serves as a stern threat to those who continue to deal in Riba after Allah revealed this warning.

Why did i have these three posts? about riba, fitna and fasad, and the necessity of accepting the decision of the messenger.

Simply to show, Sal Taseer is part of the goverment hell bent on taking us through disobedience, fitna and fasad and finally a declaration of war by Allah and his messenger.

My Lord Allah, I surrender. I cannot fight you. I do not wish to be part of this troop you have declared war on. I accept and acknowledge my part in this fitna. Forgive me and have mercy on me and guide those who have made a mockery of your deen or deal with them as you do your enemies.

      @Ali prime,

This is a complicated topic as it is. It would be better, if we stick to matter at hand which is a) what is blasphemy law in pakistan and what is its history plus how is it implemented in other muslim countries? b) is it okay to call blasphemy law in its current form a black law? c) did salman taseer commit blasphemy by calling blasphemy law a black law? d) did salman taseer ever ask to repeal the law, or just review its implementation (from other mulsim scholars and parlimentarians who added this in Pakistan Penal Code in the first place)?

The verses you have quoted are equally applicable on everyone in Pakistan (from Taliban to Government) no matter which side one is on, they don't really add any value to the discussion at hand.

To all those who are cussing Zia, they should curse ZAB first who declared Qadyanis non-MUslims. Also they should curse ZAB for making Islamic Bomb and believing in the concept of Ummah by calling IIC in 74.

By cursing Zia, liberals just burying heir hollow heads in sand.

which world ELITE MUSLIMS of Pakistan live in?

Every one around the world knows to speak carefully when they speak about Prophet Muhammad (pbuh).

There is no Blasphemy law applicable in UK but has anybody asked the life story of Mr.Salman Rushdie or Greet Wilders for that matter.

Dear Muslims wake up ……Islam is a religion which has huge following and it's followers all over the world do get offended and take it personally.

    ———–

I simply do not understand the debate on Blasphemy law going around in Pakistan.

the real issue is getting Justice to people and how to stop victimisation .

      @ Farrah shah!

How one can disagree with you..it is really shocking and sad to see that there is considerable numbers of Pakis inside Pakistan who really offended by the law itself and victimization is not their primary issue.

I simply can't understand that how the honor of a prophet could become a non issue to any Muslim? This is the biggest issue which could provoke any Muslim to take the law into his own hand and can make him do which seems impossible even for himself in normal life.

My point above is ,it is not the matter of Blasphemy law .

It is the matter of common perception , one cannot be inconsiderate to the public emotions and sentiments.

What is provocative and what is not cannot be prescribed but surely it is dictated by the public.
