Arrests outside Sindh High Court

Several lawyers and civil society activists have been arrested while protesting against PCO judge Dogar’s visit to the Sindh High Court on Thursday night.

Those arrested include Naeem Qureshi of Karachi Bar Association, K.K. Javed, Salahuddin Ahmed, Riaz Ahmed, Noor, Ayub Qureshi, Noman Qadir, Samina Noman and Anis Haroon. They area reportedly being taken to Predy Police Station.

The lawyers and members of the civil society held a strong protest demo for about one and a half hour outside the SHC and some of them succeeded in reaching its back entrance where a large number of security personnel baton-charged them and made the arrests.

One issue which we all have dodged to question ourselves, is to decide what is acceptable when the powers-to-be talk about the ‘conditional’ restoration of the judiciary, either in the form of the much trumpeted 60-point constitutional package or separately.

For me, this movement (People’s Resistance) has been for the unconditional restoration of the Nov 3rd Judiciary (which also has included condemning the Martial Law & the restrictions on the media) When the powers-to-be talk about ‘middle ground’ compromises in the restoration of the Judiciary, it is sadly FAR from our own objectives. The irony is that we, in PR all seem to be preparing for a celebration the day Zardari restores the Judiciary in whatever way he thinks its best ‘for-him’. Is this ‘whatever-way-possible’ acceptable to PR. It sadly is not my wish, and I may venture to say that it might also echo the sentiments of other like-minded friends in this group

In my opinion the only reason to make a circus of the constitutional package is to show the judges that the powers-to-be have given them grace, and they should remain grateful to have received this gift-from-god. It is just another facade to the traditional appointment by the President / establishment which ensures that the buck stops at the supreme authority thereby ensuring the status quo. I hope we, in PR, are not fooling ourselves to believe that the ‘Zardari form’ of restoration comes without any strings attached. Had they been sincere then all this hoopla was not necessary and the legal way, via an executive order, was not too difficult to pull out of the bag. As opinion makers in this resistance we should be clear on our position, and be willing to call a spade, a spade and not worry otherwise.

Long March and… a new generation learns to Mobilize

History made an entire cross section of civil society of Pakistan learned and transformed from its own struggle against rules from above. Long march ended today at 6 am with thousands of agitators sending a strong message to those in corridor of power that they know how to mobilize nationwide and the next time the rulers will not have a chance.

We are in Rawalpindi rite now. Last nite we went to Isd. A Huge no. of people in Rawalpindi/Isd are disappointed at decesion to cancel Dharna. We asked 50 people and 80% of them disagreed with Aitzaz MAny young lawyers and civil society members were Dumbstruck. They were ready for further action but were let down by the leadership. when Aitzaz started his speech many students and activists felt that the Dharna would be canceled and then they started agitating.

People present there were not consulted at all before the cancellation. If cancellation was done because of logistical reasons then proper arrangements could have been done and funds could have been raised to help those willing to sit in front of the parliament. It was done in an undemocratic fashion.

Long March preparation from Karachi

In the past few days lawyers and civil society activists have been in full swing for the preparations of the Long March to Islamabad. This procession is based on the simple one-point agenda for the unconditional restoration of the independence of Judiciary in Pakistan. A large delegation is expected to leave Karachi on the morning of Monday the 9th towards Hyderabad and onwards. The schedule is as follows

  • 9th June – Karachi – Hyderabad (2 hours stop) – Sukkur (night stay)
  • 10th June – Sukkur to Multan
  • 11th June – Multan to Lahore
  • 12th June – Lahore to Islamabad
  • 13 & 14th June – Massive protest in Islamabad with a stand off at the Parliament House

Walk for Restoration of Judiciary & CJP Iftikhar addresses Karachi Bar

The call is being issued by the Lawyers where the Chief Justice of Pakistan Iftikhar Muhammed Chaudhry will do a telephonic address the local Bar and there will be a walk to show support for the Restoration of Judiciary in Pakistan

Restore Judges not Dogars, Peoples Resistance Rally in Karachi

Image Hosted by ImageShack.usMembers of civil society in Karachi asked the democratically elected government to respect their anti-establishment and pro-judiciary mandate and not follow agenda of establishment by complicating the issue of reinstatement of judiciary.

These views were expressed after a walk was held to support the restoration of judiciary from Khadda Market to the residence of non-functional Chief Justice of Sind High Court, Justice Sabeehuddin’s residence. The walk comprising of over 100 people was organized by People’s Resistance, a loose coalition of individuals, students, teachers, professionals, human rights organizations and common citizens.

Justice (r) Fakhrudin G. Ebrahim who joined the walk said, “If one man’s blatant actions are validated indirectly, this would mean that tomorrow who ever holds power can do anything he pleases with the nation against its will”. He added that the atta crisis and every other issue facing the country today is tied to supremacy of law and only by upholding the constitution can anarchy be avoided.

Nationwide protest for the immediate restoration of the deposed judges

There will be protests in Karachi, Lahore and Islamabad on Thursday, May 8th 2008 for the immediate restoration of the deposed judges and for purging the judiciary free from the PCO inductees and conspirators of the Nov 3rd coup. Walk for the Restoration of Judiciary on 8th May

pr-logo-option-02-1.jpgPeoples Resistance shall hold a demonstration for Restoration of Judiciary on Thursday May 8th, 2008, at 6:15 pm at Khadda Market DHA (in front of Rahat milk shop). Participants will walk down to the Legal Chief Justice of SHC, Mr. Sabihuddin Ahmed’s house for a 30 minute protest.

PR expresses its disappointment that this important issue has not been addressed as promised. This protest acquires even more significance in view of the increasingly lesser chances of a solution by the 12th of May. Fakhruddin G Ibrahim opting out in protest from the core mediating body in Islamabad and the postponement of the bye-elections all have added to the crisis. We would like to reiterate the demand for urgent and unconditional restoration of judiciary.

All concerned citizens /groups are requested to join and show solidarity for the cause of restoration of original judges.

Statement by Peoples Resistance on Restoration of Judiciary

pr-logo-option-02-1.jpgKARACHI (May 5th): We, the citizens of Pakistan, welcome PPP’s and PML-N’s new promise to restore deposed judges by 12th May 2008. We hope that, this time round, the promise shall be kept.

At the same time, we condemn the proposal to retain the ‘judges’ appointed by General (R) Pervez Musharraf after 3 November 2007. These ‘judges’ happily accepted judicial appointments in place of those courageous souls who refused to bow down before a dictator and take oath under the PCO. These freshly appointed ‘judges’ were willing accomplices in Musharraf’s scheme to subvert the Constitution and destroy judicial independence and went out of their way to endorse his actions. By doing so, they betrayed the legal and judicial fraternity and the nation as a whole.

If political parties protect the appointments of such ‘judges’, they will be sending out a loud and clear message to future judges: if you dare to resist a dictator, you shall be unceremoniously removed and face months of illegal detention. On the other hand, if you endorse the dictator’s actions by taking oath under his PCO, not only will you enjoy judicial office during the dictator’s reign but any incoming democratic dispensation will go out of its way to protect you.

Walk in Karachi for Judiciary – 30th April

Participants will walk down to the Legal Chief Justice of SHC, Mr. Sabihuddin Ahmed’s house for a 30 minute protest.

PR expresses its disappointment that this important issue has not been addressed as promised and would like to reiterate the demand for urgent and unconditional restoration of judiciary. April 30th is the last day of 30-day period committed by two major political parties in Bhurban Declaration for the resolution of this issue.

Peoples Resistance meets CM Sindh for Dr. Riaz

Today afternoon a delegation of the Peoples Resistance visited the Chief Minister house and met the CM Mr. Qaim Ali Shah in a one-on-one meeting to discuss at length the issue of Dr. Riaz Ahmed and his maltreatment at the hand of Rangers on March 31st. This meeting was hurriedly arranged by the members of the People’s Resistance as a few days prior the comments made by the prosecuting lawyer showed signs of serious concern. Additionally the Judge was also under pressure to decide the case very soon and in turn simply reserved his judgment till the following week

The prosecuting lawyer made claims of an uncooperative Dr. Raiz and requested the honorable judge to arrest the Professor. All these comments have generally alerted us to the urgency with which the administration / rangers want to finalize the case, it must be mentioned that Dr. Riaz has repeatedly tried to go to the Mubina Police Station to file his FIR as per the directive of the Session Court Judge but the Police has continued to delay it on one pretext after another. Dr. Riaz’s lawyer quoted two instances where Dr. Riaz was notified to reach the police station or inquiry committee several hours AFTER the time for investigation meeting had passed. In fact, realizing that a trap was being laid, Riaz had already given a written statement to the Chief Secretary’s inquiry committee mentioning the events and the fact that he could not appear for investigation as he was notified much later than supposed to.

Looking at these typical bureaucratic delay tactics employed by the administration, we at People Resistance were extremely concerned and hence requested the Chief Minister to step in and ensure justice is served. We were pleased to note that the Chief Minster was fully aware of the issue and had already started work on the matter and promised to act upon it urgently. During the meeting we were also able to raise the demand to demilitarize the University on which he mentioned of the steps he plans to take to soon ensure the sanctity of the educational institutes in his region

Authoritarian antics of the Establishment by Arusha Noorani

A truly heartfelt email sent by Arusha Noorani daughter of Kamran Noorani one of the People’s Resistance activists who was arrested outside Justice Bhagwandas’s House two days back. The last paragraph truly reflects the frustrations of practically everyone in Pakistan

My parents were part of a peaceful vigil yesterday outside deposed judge, Justice Bhagwandas’ house, to protest against his virtual house arrest. Police mobiles arrived and picked up some of the men in the group, including my father and Salahuddin Ahmed a close friend (who had previously been arrested in connection with the lawyers movement). They were released late at night after a request was put in, however an FIR was registered against them. They were allegedly disrupting the peace. Sections 147 and 148 of the Pakistan Penal Code deal with rioting and rioting with a deadly weapon (candles???).

Ironic that peace activists are accused of disrupting the peace. What peace? And at what price? Must people barricade themselves in their homes and public figures disappear from the public eye to achieve this peace. I wonder how long this cavalier attitude towards citizens rights will continue.

The People’s Resistance would like to share with the world images from the ‘peaceful’ candle light vigil held outside the house of Justice Rana Bhagwandas who has been placed under house arrest since yesterday. Civil Society members showed up today to show their support and solidarity with the honorable justice during this difficult time. It is during this vigil that police felt the need to arrest eight male members and harrassed the female members.

Report from Darakshan Police Station After the Arrests

I would like to share an email sent into the People’s Resistance network by Abira Ashfaq who managed to sneak inside the poilce station along with Moneeza to help keep an eye on the 8 civil society activsits arrested outside Rana Bhagwandas’s House

So everyone is out. The good news is that many people and the media showed up at the thana. It may not always be a happy ending.

I was inside the police station for at an hour and a half, and they had basically decided they were not going to give us any information or allow Moneeza and myself to see the detainees. We had managed to get in by fluke, and after us they would not let anyone in. In fact they tried to get us out, but we said we’d wait. But they did not allow us privacy when we were on the phone, and followed us around. At one point, the SHO threatened Moneeza that if wanted “vo us ko bahir karah kara de ga.” They maintained that the decision for FIR’s, bail and release would be made at the Clifton thana, and that we should go there. A nice crowd had gathered outside the thana. SHO Ehsan was planning to leave, but when he saw the crowd and our resolve to stay, he decided to stay at the thana.

When we pressed the SHO about why these arrests were made, he was cryptic and said that he knew and I knew why this was happening. And he knew and I knew that I would not be allowed a visit even though that maybe a legal right. He made constant references to invisible hands. We got to talking about the violence after BBs death and he suggested that police did not go out as there would have been bloodshed.
